1. Agreement to Terms
These Terms and Conditions apply to the website located at www.GreenAquarium.com.au (the “Website”).
In these Terms and Conditions, “Green Aquarium”, “we”, “us” or “our” refers to the business operated under the registered business name Green Aquarium by the holder of ABN 55 603 092 667. “You”, “your” or “customer” refers to any person who accesses the Website or purchases products from us.
By accessing, browsing or purchasing from the Website, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use the Website.
By placing an order through our Website, you agree to these Terms and Conditions.
We may update or change these Terms and Conditions from time to time. Any changes will take effect when the updated Terms and Conditions are published on the Website. It is your responsibility to review the current Terms and Conditions before making a purchase.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law (ACL) or any other applicable law.
2. Website Information
We make reasonable efforts to ensure that the information on our Website is accurate and up to date. However, product descriptions, images, availability, prices and other information may occasionally contain errors or become outdated.
We reserve the right to correct errors, update information and make changes to products, pricing and availability without notice.
Information provided on the Website is for general information purposes and should not be relied upon where more specific advice or information is required.
3. Product Images and Livestock Photos
Livestock Photos
Our Website may contain photographs of fish, shrimp, other aquatic livestock, plants and aquarium products.
Some photographs may be sourced from Adobe Stock, manufacturers or suppliers, while others are photographs taken by Green Aquarium.
Where multiple product photographs are displayed, the first image may be a representative or stock image. Where a second image is provided, it may show an example of the actual product available.
Because livestock and plants are living products, their appearance can naturally vary.
The colour, size, shape, markings and overall appearance of livestock and plants may differ from photographs due to:
- Lighting conditions.
- Photography and display settings.
- Age and growth.
- Stress associated with transportation.
- Water conditions.
- Acclimation to a new aquarium.
- Natural variation between individual specimens.
Packaging and containers may also vary. For example, aquatic plants may be supplied in pots, cups or other suitable packaging. The species supplied will correspond to the product description.
Some plants, particularly red varieties, may appear greener when supplied and may develop stronger coloration after being established under suitable aquarium lighting and water conditions.
Where a product has specific requirements or characteristics, these will be described in the relevant product listing where reasonably possible.
If you have questions about a product before ordering, please contact us before completing your purchase.
4. Cookies
Our Website uses cookies and similar technologies to provide functionality, maintain your shopping cart, support account functionality and improve your experience.
When you log in, cookies may be used to remember your login and display preferences.
Selecting “Remember Me” may extend the duration of your login session. Logging out will remove applicable login session cookies.
For more information about how we collect and use personal information and cookies, please refer to our Privacy Policy.
5. Orders and Payment
Adding an item to your shopping cart does not reserve or guarantee availability of that item.
An order is submitted when you complete the checkout process. Your order is subject to acceptance and product availability.
Payment must be successfully authorised and received before an order is processed for dispatch.
We accept the payment methods displayed on our Website at the time of checkout. These may include:
- Visa and Mastercard.
- PayPal.
- Apple Pay.
- Google Pay.
- Afterpay.
- Other payment methods made available through our payment providers.
Payments are processed through third-party payment providers. We do not store your full credit card details on our Website.
Payment providers may have their own terms and conditions and privacy policies, which may also apply to your transaction.
6. Acceptance of Orders
We reserve the right to decline or cancel an order where permitted by law, including where:
- A product is unavailable.
- There is an obvious pricing or listing error.
- We are unable to obtain or supply the product.
- Payment has not been successfully authorised.
- We reasonably suspect fraudulent or unauthorised activity.
- Circumstances outside our reasonable control prevent us from fulfilling the order.
If we cancel an order after payment has been received, we will provide an appropriate refund for the amount paid for the cancelled products.
This does not affect any rights you may have under the Australian Consumer Law.
7. Age Restrictions
If you are under 18 years of age, you should only place an order with the involvement and consent of a parent or legal guardian.
By placing an order, you confirm that you are legally permitted to enter into the transaction.
8. Order Cancellation
If you need to cancel an order, please contact us as soon as possible at [email protected].
We will make reasonable efforts to accommodate cancellation requests where the order has not yet been processed, packaged or dispatched.
Once an order has been packaged or dispatched, cancellation may no longer be possible.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
9. Stock Availability
We make reasonable efforts to maintain accurate stock information. However, stock availability may change unexpectedly, particularly for live aquatic livestock and other products with limited availability.
If a product you have ordered becomes unavailable, we may contact you to discuss available options, which may include:
- Supplying a suitable alternative where you agree to the substitution.
- Shipping the available items and refunding the unavailable item.
- Providing a refund for the unavailable item.
- Providing store credit where you agree to this option.
We will contact you where reasonably necessary to discuss the available options.
10. Live Plants and Livestock
Live plants and aquatic livestock are living products and can be affected by transportation, temperature, water conditions and other environmental factors.
We take reasonable care when selecting, preparing and packaging live products for shipment.
Customers are responsible for ensuring that their aquarium and receiving conditions are suitable for the products ordered, including appropriate temperature, water quality and acclimation procedures.
Problems with Live Products
If a live plant or livestock product arrives in an unacceptable condition, please contact us within 24 hours of delivery and provide photographs of the product and packaging where reasonably possible.
This 24-hour notification period is intended to allow us to assess the condition of the product shortly after delivery. It does not exclude or limit any rights or remedies you may have under the Australian Consumer Law.
We will assess each situation individually and, where appropriate, provide a replacement, refund or other remedy in accordance with applicable law and our Refund and Returns Policy.
11. Shipping and Delivery
We offer delivery to selected Australian locations using the shipping services displayed during checkout.
Available delivery services, delivery costs and estimated delivery times may vary depending on:
- Your location.
- The type of product ordered.
- The shipping service selected.
- Courier and postal network conditions.
- Weather and other environmental conditions.
- State and Territory biosecurity or other legal restrictions.
Estimated delivery times are estimates only and are not guaranteed delivery dates.
Some products, including live plants and livestock, may have different shipping requirements or may not be available for delivery to certain locations.
We reserve the right to restrict or decline shipment of a product where shipping it to a particular destination is prohibited, restricted, unsafe or otherwise not reasonably possible.
Customers are responsible for providing a complete and accurate delivery address, including any required contact information.
If an incorrect or incomplete address is provided, additional delivery costs or delays may occur.
Where a shipping provider experiences a delay after an order has been dispatched, we will assist with enquiries where reasonably possible but cannot control the operation of third-party postal or courier services.
Where required by law, nothing in this section limits your rights in relation to products that are lost, damaged or otherwise not supplied as required.
12. Pricing
All prices displayed on the Website are in Australian Dollars (AUD).
Where Green Aquarium is required to charge GST, applicable GST is included in the displayed price unless otherwise stated.
If Green Aquarium is not required to be registered for GST, prices may not include GST.
Prices may change without notice due to factors including:
- Supplier and manufacturer price changes.
- Changes in market conditions.
- Currency fluctuations.
- Promotional pricing.
- Pricing or advertising errors.
If you have already completed an order and payment has been successfully received, a subsequent price change will not affect the price of that confirmed order, except where the order is affected by an obvious pricing or listing error.
Where an obvious pricing error has occurred, we may contact you before fulfilling the order to discuss the error and available options.
13. Refunds and Consumer Guarantees
We comply with the Australian Consumer Law.
Australian Consumer Law provides consumers with certain rights and consumer guarantees in relation to goods and services. These rights cannot be excluded by these Terms and Conditions.
Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy where a product does not meet the consumer guarantees that apply to it.
Our assessment of a return, refund or other remedy will take into account the nature of the product and the circumstances of the issue.
For more information about our specific returns and refund procedures, please refer to our Refund and Returns Policy.
Nothing in these Terms and Conditions or our Refund and Returns Policy limits or excludes your rights under the Australian Consumer Law.
14. Privacy

Where you create an account, we may retain information associated with your account, such as your name, contact details and order information.
You may be able to access, update or request deletion of certain personal information associated with your account, subject to applicable legal, administrative and security requirements.

However, nothing in these Terms and Conditions excludes, restricts or modifies any rights, guarantees, warranties or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Where the law permits us to limit our liability, our liability will be limited to the extent permitted by law.
